Civil Court Rules Ministry Error in “Binveriya” Scheme Eligibility Determination
The Civil Court has overturned the Housing Ministry’s decision, declaring that the Ministry erred in deeming an individual ineligible to submit documented applications under the “Binveriya” scheme from the previous government.
The case, Fathimath Ahmed, K. Male’ Dhaftharu No. 234, who filed the lawsuit on October 23. Initially, the Ministry excluded Fathimath Ahmed’s name from the provisional list, despite submitting the required documents in accordance with the scheme’s guidelines.
Although Fathimath Ahmed provided his resident registry and birth certificate, the civil court noted that the individual did not present any evidence to refute the Ministry’s decision. According to the court’s judgment, the Housing Ministry had determined that the individual failed to meet the necessary criteria for inclusion in the permanent list.
Seeking validation of identity and the restoration of the individual rights, Fathimath Ahmed pursued a civil suit against the ministry.
Yesterday, Judge Faisal Adam of the Civil Court ruled in favor of Fathimath Ahmed, affirming eligibility for the “Binveriya” Scheme. The court ordered the allocation of land to Fathimath Ahmed following the established procedures for land transfer.
Individuals dissatisfied with the court’s decision have the option to appeal the case within the next 30 days.
