Healthcare Workers Union Raises Concerns Over Unpaid, Excessive Overtime Work

The Maldives Health Professionals Union (MHPU) has raised alarm over violations of labour regulations regarding overtime compensation, following the implementation of the new salary structure.

Citing Standard No: 478-NPC/2022/ST-08 issued by the National Pay Commission under the Ministry of Finance, the MHPU highlights a specific provision stating that overtime pay per month should not exceed 10 percent of the basic salary of the position. This regulation, aimed at safeguarding workers’ rights, prohibits employees from working beyond this threshold.

According to the MHPU, members who have migrated to the new salary structure are not receiving overtime pay in accordance with the stipulated regulations. This discrepancy has prompted the union to take action, advocating for fair treatment and adherence to labour laws.

In a statement issued by the MHPU, they referenced an email exchange with the Labour Relations Authority (LRA) in June 2023. The LRA acknowledged that working without overtime pay is illegal and encouraged parties affected by such practices to file complaints.

Furthermore, the MHPU draws attention to Maldives’ commitment as a member of the International Labour Organisation (ILO). They highlight Article One of the ILO convention, which pledges to eradicate forced or compulsory labour in all its forms. The union argues that the current situation, where healthcare workers are compelled to work overtime without proper compensation, constitutes a form of forced labour and is in violation of international labour standards.

The union emphasises that the healthcare industry is already grappling with staffing shortages, placing additional strain on existing workers. Particularly during challenging periods such as Ramadan, healthcare professionals are forced to work extended hours without adequate compensation, jeopardising their physical and mental well-being.

In light of these concerns, the MHPU calls upon employers to adhere to the new labour framework and refrain from exploiting healthcare workers. They urge authorities to enforce existing regulations regarding overtime compensation and ensure that workers are fairly remunerated for their services.
