LGA Dismisses ‘Legal Vacuum’ Claims After Abolition of Atoll Councils and Ministry

The Local Government Authority (LGA) has dismissed claims that recent structural changes to local governance will create a legal vacuum, stating that existing laws clearly provide for the transition of powers and responsibilities.

In a statement issued today, the authority said assertions circulating on social media regarding legal uncertainties following the abolition of Atoll Councils and the Ministry of Cities, Local Government and Public Works are unfounded. 

The clarification comes amid ongoing changes to the local governance framework, including the phasing out of Atoll Councils following legislative amendments. 

According to the LGA, the Constitution mandates that the Maldives’ administrative divisions be governed under a decentralised system. While the establishment of island and city councils falls under the President’s mandate, the authority said it is legally responsible for supporting these bodies and ensuring the continuation of services.

The LGA further explained that under the 17th Amendment to the Decentralisation Act, functions previously carried out by Atoll Councils will be transferred to the authority. This includes the legal takeover of assets, resources, and responsibilities previously held by the councils.

The authority also noted that it has the legal mandate to establish offices to carry out these responsibilities, ensuring continuity in governance and service delivery.

Reaffirming its position, the LGA said the legal framework explicitly outlines the transition process, meaning there are no gaps in authority or responsibility despite the institutional changes.

The statement added that once the terms of existing Atoll Councils conclude, their roles will formally shift to offices operating under the LGA. Authorities have also assured that the transition will safeguard employee job security while maintaining uninterrupted public services.
