As outlined in the Police Act, the President will appoint the Commissioner based on the advice of the Minister, choosing from the list of candidates submitted by the Police Board. In this case, the Police Board has exclusively put forward the name of Assistant Police Commissioner Ali Shujau to Minister of Homeland Security and Technology Ali Ihusaan.

The appointment process mandates that candidates undergo interviews and assessments by the Police Board. Additionally, the Police Board is required to seek input from the National Integrity Commission and the Police Professional Standards Command. These entities provide a comprehensive report on the candidate, outlining their qualifications, reputation, and any reasons that might disqualify them from the position.

The position of Police Commissioner became vacant following the retirement of the incumbent on November 15.
