Civil Court Petition Seeks Halt To Gedhoruveriya Flat Handover

An interim order has been sought from the Civil Court to halt the government’s handover of flats under the Gedhoruveriya housing scheme to individuals already included in the earlier allocation list.

The previous administration allocated space for 4,000 flats to be constructed by the Fahi Dhiriulhun Corporation (FDC). Although the current government initially planned to review the eligibility of recipients, it later opted to proceed with the earlier list. The Ministry of Housing has stated that 700 names could be removed from the permanent list published previously, while agreements for the flats are now being processed.

The petition was filed on Monday by a civilian whose name had been excluded from the earlier list despite agreements having been signed under the previous administration. His lawyer, Mohamed Nishan Ibrahim, said the petitioner had requested an interim order to prevent the flat from being handed to another individual until the court reaches a decision.

Galolhu North Councillor Mohamed Saif Fathih, who has been assisting affected individuals in his constituency, attended the hearing. He said a number of people with agreements signed under the former government have since been informed that they will not be allocated flats.

According to Saif, more than 60 individuals have been excluded, and separate legal cases will be filed on their behalf. He noted that the aim was not to disrupt the current handover but to pursue claims through the courts.

Lawyer Nishan has encouraged all individuals with agreements under the previous government to take legal action, arguing that the removal of names and reallocation of flats contravenes the Contract Act.
