Hassan Shiyam’s Candidacy Revoked by Supreme Court for Parliamentary Election

The Supreme Court has made a ruling to revoke the candidacy of Hassan Shiyam, who was contesting for the Central Henveiru constituency in the forthcoming parliamentary election.
The case was brought to the attention of the Supreme Court by Ilyas Ahmed, the brother of the incumbent Central Henveiru MP, Ali Azim. The basis for revoking Shiyam’s candidacy was a proven debt.
In its verdict delivered on Thursday, the Supreme Court, with a panel of three justices comprising Justice Dr. Mohamed Ibrahim, Justice Husnu Al Suood, and Justice Aisha Shujoon, unanimously decided to annul Hassan’s candidacy on the grounds that he did not fulfil the requirements to stand in the parliamentary election.
The issue stemmed from Crystal Lagoon Resort’s failure to repay two loans, amounting to USD 10 million in 2006 and MVR 64 million in 2008, obtained from the State Bank of India (SBI). Hassan Shiyam was among the 11 individuals who provided guarantees for these loans.
Following a ruling by the Civil Court ordering the guarantors to settle the debt, which remained unpaid despite the court’s decision, the Supreme Court approved the sale of two mortgaged resorts as part of enforcing the judgment.
Shiyam attempted to obtain an order from the Civil Court absolving the guarantors of any remaining debt after the sale of the resorts, but this request was denied. The decision was upheld by the High Court on February 13th, which maintained that the guarantors were liable for the proven debt despite temporary provisions in the Civil Court’s civil procedure code.
This issue regarding Hassan Shiyam’s debt had also arisen during the previous parliamentary election. However, at that time, the Supreme Court had ruled him eligible to contest the election.
