State Declines Extension for Out-of-Court Settlement in Sadha’s Case

The state has rejected an extension by the Civil Court for an out-of-court settlement in the medical negligence case involving the death of Sadha Saudhulla, a five-year-old girl from Fuvahmulah City.
Sadha was admitted to Fuvahmulah Hospital on 3rd October 2021, suffering from stomach pain and vomiting, after being unable to receive treatment at the flu clinic.
The Human Rights Commission of Maldives (HRCM) found sufficient grounds to believe that negligence by doctors and nurses contributed to her death. The commission further stated that the family had the right to pursue compensation.
Subsequently, Sadha’s family filed a lawsuit against the Ministry of Health in the Civil Court, seeking compensation. During a hearing on Sunday, the family’s lawyer indicated their willingness to negotiate an out-of-court settlement if the state admitted to medical negligence. The court allowed two days for discussions between the parties.
However, after the extended period for negotiations expired on Wednesday, the state pleaded not guilty to the civil charges and declined the offer of an out-of-court settlement, opting instead to seek a legal remedy through the court.
At Sunday’s hearing, the family’s lawyer, Mariyam Shunana, explained that Sadha’s parents were inclined towards a settlement due to the prolonged court process delaying justice.
The HRCM investigation into Sadha’s death led to the suspension of the medical licenses of two doctors involved in her treatment. The commission’s findings also highlighted that the medical staff failed to properly review Sadha’s medical history and delayed treatment, despite the urgent nature of her condition.
